Terms and conditions

Welcome to Curious Movement Community (the “Community”), the online community of Breathe In Qigong, operated by [LEGAL NAME / Sifu Michael Brisbois] (“we”, “us”, or “our”). These Terms and Conditions (“Terms”) are a legally binding agreement that governs your access to and use of this community platform and its features (the “Service”). By creating an account or using the Service, you confirm that you have read, understood, and agree to these Terms. If you do not agree, please do not use the Service.

1. Who can use the Community

You must be at least [16] years old to create an account. By registering, you confirm that the information you provide is accurate and that you’ll keep it up to date, and that you have the capacity to enter into these Terms. You’re responsible for keeping your login details secure and for all activity under your account. 2. Your licence to use the Service

We grant you a personal, non-exclusive, non-transferable, revocable licence to access and use the Service for your own non-commercial practice and enjoyment, subject to these Terms. You agree not to:

  • sell, rent, lease, sublicense, or otherwise commercially exploit the Service;
  • copy, modify, reverse-engineer, decompile, or create derivative works from any part of the Service;
  • use the Service to build a similar or competing product or service;
  • remove any copyright or other proprietary notices.

We may change, suspend, or discontinue any part of the Service at any time, and we have no obligation to provide support or maintenance.

3. Membership and access

Some areas, classes, or features may be free, and others may require a paid membership or subscription. Where a fee applies, the price, billing cycle, and any renewal terms will be shown to you before you purchase, and payments are handled by our third-party payment provider. Unless stated otherwise or required by law, fees are non-refundable.

4. Community conduct

This is a supportive, respectful space. When you take part, you agree not to:

  • harass, bully, threaten, or abuse others, or post hateful or discriminatory content;
  • share content that is unlawful, defamatory, obscene, invasive of privacy, or harmful;
  • post anything harmful to minors;
  • post spam, advertising, or repeated unsolicited promotion;
  • impersonate any person or misrepresent your affiliation;
  • share other people’s private information without their permission;
  • upload viruses or attempt to disrupt, hack, overload, or gain unauthorised access to the Service, other accounts, or our systems;
  • use bots, scripts, or automated means to access the Service, create multiple or fake accounts, or scrape or harvest other members’ information;
  • present dangerous or misleading health claims, or advice that could put others at risk;
  • infringe anyone’s intellectual property or other rights.

We may review content and, at our discretion, remove or modify it, suspend or close accounts, or report activity to the authorities if these Terms are broken or if doing so protects the Community.

5Your content

You keep ownership of the content you post — your words, images, and recordings (“Your Content”). By posting, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, display, and share Your Content within the Service so we can operate the Community. You’re responsible for Your Content and confirm you have the rights to share it, and that it doesn’t breach these Terms.

We’re not obligated to store or back up Your Content, and it may be removed or lost — please keep your own copies of anything important. We don’t routinely review everything members post and aren’t responsible for it.

Important — health and wellbeing

Curious Movement Community offers wellness education only. Qigong, Reiki, breathwork, meditation, and related practices shared here are not medical advice, diagnosis, or treatment, and are not a substitute for care from a qualified healthcare professional. Sifu Michael Brisbois is a Medical Qigong instructor and Reiki Master, not a physician. Always practise within your own comfort and ability, stop if you feel unwell, and consult your doctor before beginning any new movement or wellness practice — especially if you are pregnant, elderly, frail, or living with a medical condition. You take part voluntarily and accept that you do so at your own risk. No particular results are promised or guaranteed.

6. Our content and intellectual property

Aside from Your Content, the Service — including its design, text, logos, course materials, and the teachings shared by Sifu Michael — is owned by us or our licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-transferable licence to use the Service for your own non-commercial practice. You may not copy, record, resell, or redistribute our classes or materials without our written permission. If you send us feedback or suggestions, you agree we may use them freely without obligation to you.

7. Reporting copyright infringement

We respect intellectual-property rights and expect members to do the same. If you believe content on the Service infringes your copyright, please send a written notice to mbrisbois1965@gmail.com that includes: your contact details; a description of the work you say has been infringed; the location (such as a link) of the material on the Service; a statement that you believe in good faith the use isn’t authorised by the rights holder or the law; and a statement that your notice is accurate and that you are the rights holder or authorised to act for them. We may remove infringing material and may close the accounts of repeat infringers.

8.Third-party links and services

The Service may link to third-party websites, tools, or content that we don’t control. We provide these for convenience and aren’t responsible for them; your use of them is at your own risk and subject to their terms.

9.Interactions between members

The Community connects you with other people, and you’re responsible for your own interactions. We don’t control members’ content or conduct and aren’t responsible for it. If a dispute arises between you and another member, we have no obligation to get involved — though we may act to protect the Community at our discretion.

10.Disclaimers

The Service and all content are provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory — including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We don’t warrant that the Service will meet your needs or be uninterrupted, timely, secure, accurate, or error-free, to the fullest extent permitted by law.

11.Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any lost profits or data, arising from or relating to your use of (or inability to use) the Service or your participation in any practice shared through it. 12.Indemnity

We may assume the exclusive defence of any such matter, and you agree to cooperate with us.

13.Suspension and termination

You can stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or to protect the Community. Ending your account may involve deleting Your Content from our active systems. Provisions that by their nature should survive — including licences already granted, intellectual-property terms, disclaimers, limitation of liability, and indemnity — will survive termination.

14.Electronic communications

When you use the Service or email us, you’re communicating with us electronically, and you consent to receive communications from us electronically, such as emails and notices posted within the Service. You agree that these electronic communications satisfy any legal requirement that a communication be in writing.

15Changes to these Terms

We may update these Terms from time to time. When we do, we’ll revise the “Last updated” date above and, where appropriate, let you know. Continuing to use the Service after changes take effect means you accept the updated Terms.

16Governing law and disputes

These Terms are governed by the laws of [JURISDICTION — e.g., Thailand], without regard to conflict-of-law rules. You agree that the courts of [JURISDICTION] will have jurisdiction over any dispute, unless local law gives you other rights. 17.General

These Terms are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest still applies, and the unenforceable part will be limited to the minimum extent necessary. Our not enforcing a provision isn’t a waiver of it. You may not transfer your rights under these Terms without our consent; we may transfer ours. Section titles are for convenience only, and “including” means “including without limitation”.
